Yeah I don't blame you @stonecolddeanaustin, I promise I only saw it as Michael Vaughan and Sir Ian Botham retweeted them:

1 - I'm hearing that Ben Stokes intervened to help two gay guys who were being abused by yobs, one of whom was armed with a bottle.

2 - Stokes has told friends he was incensed by the homophobic taunts, then saw the bottle being raised & decided to defend himself.

3 - Stokes obviously regrets what happened but apparently his view is: "The started it, I finished it. I was protecting those guys."

4 - Police are aware of Stokes' version of events & are now trying to find the two gay men, to corroborate what he's said.

5 - Stokes has told friends: "The guy had a bottle in his hand and was threatening us, was I supposed to wait until he smashed it in my face?"

I could be wrong but I think @talkshowhost86 is in the legal profession so could enlighten us...

My mate who is also in similar, is basically saying that Stokes is fucked in the current light, as regardless of the alleged homophobic abuse, I quote "You cant just lump a **** and get away with it."

However, if this all rings true and they can find the guys to corroborate the story, I could see all charges being dropped in negotiation with the guy who got the pasting, to save him getting hauled up in the dock for being abusive with a bottle. Potentially a bit of compensation money could change hands too.

The ECB will end up reprimanding Stokes anyway for being out that late, they may strip him of the VC, but hopefully that's as far as it will end up going.

Not a criminal lawyer but provocation doesn’t get you out of trouble.

It might be considered during sentencing if found guilty but it’s still assault.

Is it that bad? The 2 guys got what they deserved the way I saw it, throwing bottles around,then being all defensive when they have no more weapons on hand.

The way you and I see it doesn't necessarily mean The Law sees it the same though mate.

His problem is that if you go on the footage we have all seen there's a bit of windmilling and a tumble to the floor, They all get up, but the two Stokes is having verbals with are then walking away, and one you can clearly see has his hands up on the defensive, and Stokes is going after them and then starts throwing punches - that bit is entirely one-sided.

I suspect legally there could well be some way out of it for both sides in getting it settled, but as I said last night its bad from a PR point of view more than anything in that at the end of the footage it is completely one-sided with Stokes raining punches and then laying someone out. If that was an England footballer the demands would be that he gets bounced out of the squad.

My personal opinion taking everything else aside, is that the video looks horrendous, and if Stokes was to lose the vice-captaincy then he couldn't complain.

I think anything to do with shanking him out the squad is totally unjustified.

If he was in prison though...

Not really news, there is only one game left until the Ashes in November, Stokes is injured and Hales isn't in the squad. Neither were going to play tomorrow anyway.

Agreed . I was thinking about if from the point of view of the ecb, no way should they ban him from the ashes over this imo

They've been right to take him out the last two games of the ODI while the investigation is ongoing. Now that this stuff is coming out about the context of when the fight happened, I assume they will wait for a bit more public support to be drummed up and then say that Stokes suspension has been lifted in a couple of weeks.

Again, that's of course under the proviso that Stokes doesn't do bird.

TBF Harvey was seen waving a bottle at some gays... :cautious:



Be sad if he's fucked his career over this, we've all seen people get carried away in the heat of the moment, just nowadays everyone has a hi-def video camera on them.
