So basically, IF I ever meet the twat and on that given occasion I choose to self identify as a police officer I can go to town on him... Just want to make this clear as I don't want to be charged with anything.... Or should I wait for my solicitor before I set about his love spuds with a cricket bat.

Why are people still thick enough to think that refusing to do a breathalyser will get them off?

Saunders has clearly never seen an episode of traffic cops.

I don't think it's necessarily that people think they'll get off, more that they think it sounds better. I suppose the warped logic is that if you get a drink-driving charge you'll forever be associated with drink-driving which, quite rightly, is nowadays a pretty taboo subject. On the other hand I suppose people think if they get charge with "failure to provide a sample" they don't have the stigma of being a drunk driver attached to them for the rest of their days. Obviously it doesn't really work like that in practice because everyone "knows" that if you refuse to provide a sample it's more than likely it's because you were absolutely plastered anyway so the stigma is still there.

Also in his case, based on the video, it seems like in his drunken state he thinks if he plays dumb and drags things out as long as possible that he might just sober up enough to pass the breath test. Presumably though, police see this routine all the time.

I could be wrong but I think I read it actually works the other way, police will quite often drag out the 'providing a sample' part, as the longer it takes the more alcohol gets into your blood/piss/breath.

That's surely entirely dependant on the situation though. If you've just downed 3 shots of tequila before getting in the car and being pulled over 5 mins later then your level of alcohol is probably still going up because you're processing the drinks you just had. But if someone's had a few drinks at a party, for example, and then stopped drinking and "waited it out" until they think they're alright to drive then get pulled over, their alcohol levels will be gradually decreasing.

Based on the interaction in the video, it seems to me like they're quite keen to get him to do the test ASAP. Presumably that's also why the rules are that if you don't give a sample straight away then you automatically get charged with failing to provide a sample, as they keep explaining to him

Oh yeah it all depends on the situation and the individual, but this is a lot to do with why you can still be over the limit the next morning for example...it can take hours for the alcohol to get from your gut and into your blood.

I'd take a guess that they don't drag anything out as it's tedious enough dealing with a drink driver, so they probably just go through the motions. If they delay for any reason at all it's more likely to let the individual settle down a bit. Unless it's coming up to the end of their shift and hanging about will mean they don't have to go back out and risk getting another job that'll take them over time, I can't think of any reason a copper would want to drag anything out.

Without knowing the technicalities of how the alcohol in the system works with each individual, the bottom line is that the police would do it as soon as they possibly can no matter what.

It does appear that he’s trying to drag it out thinking it’ll wear off but he’s a mixture of very drunk and very thick so it’s difficult to tell exactly what path he’s trying to choose.

There are ways to try and lower your alcohol limit (rapid exercise, but even that won’t get it down hardly) but it’s impossible to do it in-between getting arrested and taking the breath test at the station. Unless you jog back.
