Why are overhead kicks not fouls for having your foot too high?

Carlton Cole's goal today was much more dangerous than most free kicks given for other times I've seen players having their feet too high. Micah Richards was very close to being kicked in the head by Carton Cole, so why wasn't it a foul?

Is it just because they look good? To me, this just seems like another ridiculous inconsistency in the rule book, or just by referees.

they often are ruled out unless the player gets full, clean contact with the ball and it isn't deemed to be 'reckless'

For example, Micah Richards put his head right near it to try and defend it - that was his doing, whereas if a guys head was already right next to the ball, or challenging for it, then an attempt to bicycle kick it would be deemed reckless.

it's a pretty fine line though.

They are when kicked close to an opponents head.

Don't know what was the case today since i missed the goal but if it was a dangerous kick and it was a given goal the ref was wrong.

Richards chose to put his head in and the ref had a good view of it.

I thought the same his foot was high and defenders are expected to challenge for balls like that in the area especially at head height, Anywhere else on the pitch and if the same thing would have happened the ref would have blown his whistle.
