The defender does sweep his leg to try to catch the attacker, so the intent is there.
I think he makes contact too.
It is 99% a dive, but that defender is not in a position to say anything.

Yes he is. He's in a position to tell him to get up and start acting like a man. Pathetic behaviour.

Of course it's a dive. there's possibly minimal contact which couldn't possibly bring the player down. He then takes a step forward and throws himself on the ground pretending that the 'contact' caused him pain. Need red cards for this sort of shit - it's every bit as bad as the 'professional foul'.
