Rumours coming in that am for the last week or so have been ducking sotons phone calls. Could it simply be that they don't want to pay them compensation? That thry have purposefully pushed it over the deadline so as not to pay it and soton are screwing?
Either way i don't see why it would effect us buying him.

His main ITK was a question. "Toby or not Toby" - in hindsight, like we are pondering over the move - whether to go ahead knowing there may be legal issues or not go ahead. He did say no, but he also said if situation changes, then may be. Last ITK is 'its complicated'.

JJ couldn't give more because of legal complication - so he said for non-commercial reasons, it may not happen.
I dunno, you were talking as if you expect us to sign him. Imo, JJ seems to have always leant towards us not signing him so I just didn't see how what he had said would translate into us expecting to get the deal over the line.

Not knocking his info as obviously things change every day. This is obviously a unique transfer but there's so many discrepancies between the different media sources and the itk. I don't think anyone really knows what's going on considering Levy was supposedly in Spain over the weekend. Would sources really be getting that information so quickly?

If AM have really been screening phone calls them more fool Southampton for not using a different number

No exactly the opposite. Only JJ knew. But in hindsight every word he said then makes sense now. He said a no - because it was a no then. Now its complicated. Situation changes. Only he can clear this out.

This is all coming down to Atleti and Soton at this point, i don't have a clue what is actually going on but the reports of the buy-out clause that AM had in the loan deal make it very confusing...

AM doing anything with the fee aside from flat out paying the buy-out would be stupid.

Since the beginning of the summer they have had, at a minimum, Spurs/Soton/CFC with reported interest in TA at that point just cough up the cash to give yourself control of the sale.

At this point hopefully it is just a case of convincing TA that we have given the best offer and then letting AM and Soton bicker about who should have paid what to whom.

I don't understand the legalities of the original loan/option to purchase agreement. But the Southampton argument seems to be that they reached an agreement last year to purchase Toby at a set price; if Atletico wanted to cancel that agreement, AM had to pay a certain amount by a deadline - presumably June 30; Soton claim AM did not pay the required amount, thus Toby is now Soton's player.

What is left unanswered is whether Toby agreed to personal terms beyond the loan, and whether Soton have in fact paid what they owe to AM.

IMO Southampton;s legal options are limited. As has been said, the cannot force Toby to sign for them, so an injunction isn;t going to be granted

If Southampton sue Athletico Madrid I cannot see they can prove any ;loss - except for the £1.5m AM were supposed to pay Southampton to get out of the transfer clause. So if AM have paid the £1.5m , there is nothing they can sue AM for.

So AM gain about £5m increased fee from Spurs for him a a cost of £1.5m. Net they gain £3.5m.

My guess is that Toby will be announced as a Spurs player in a couple of days time.

Very limited time, I have seen him, he hasn't impressed me at all.
But then , am not a expert in scouting. He is just 18. So, who knows.

Clubs don't mess around. If Athleti lapsed on the buy out clause of loan - it is for a reason. By not paying, they risk a legal battle - but its a legal battle for a player who they don't need. Even if Athleti lose the legal case, the worst they could lose again is the same 1.5m IMO. I can't see how a court (in UK or Spain or international) could give extraordinary compensation (far greater than 1.5m) for a player who Saints don;'t have, Also courts will of course look at player preferences. If Toby signs for Spurs, I find it improbable how Athleti will be fined for > 1.5m.

By not paying buy back, Athleti have put the ball in Saints court. Its now up to Saints to take them to court for a player who may not want to play for them. Do they have the energy & willingness to go ahead with it ?

From Spurs point of view, they have given 11m, which is 4.5 m more than Saints 6.5m clause. This means Athleti gets 3m more than buy out clause. Even if court decides a higher compensation, they would still be in profit.

If Saints decides to match Spurs offer, then they have no case as well.

If player decides to move to Spurs, nothing Saints do will stop him from joining Spurs.

I am a bit worried with the type of transfer strategy we have... we sign kids and depend on their development to break into top 4. I am not saying this is no good but we need experience or at least one or two established stars.

I cant imagine we sign all unknowns in a window. FFS.
