I still don't see how Toby can legally go Spurs. So what if we will get a cash settlement when we take it to court, shouldn't it be ruled that our settlement should be the right to signing Toby? If the contract says what we think it says than how are Spurs and AM allowed to proceed?

Denial could last a while it seems.....

Contract law remedy is damages, and equity won't be applicable if Toby wants to sign for us instead as equity isn't designed to benefit one side to the detriment of another.

True. Still, Alderweireld and a deal that has the potential to be huge for us going through still makes a pretty good week for me :)

@ Batman, Definition of a top six club is where it finishes not how big it is, if it was defined by that then Manchester United would be favs to win the league every year cause they are after all the biggest team in the league by a big margin. we are the 15 th biggest team, but are a top 8 team. Spurs are in every way a top 6 team league position and by size. but we only finished 2 points off them and I believe the club can close that little gap up, so that is what i meant by a so called top 6 team as i fully expect us to be challenging them again this season and finish above them.

Back to the topic.

From what i understand, Toby could have agreed a deal with Saints before the agreement with AM was signed ( not always does this happen, But some times the player agrees in advanced in the loan to buy option ).

If this is the case and AM missed the dead line then he is a Saints player legally.

if i can recall interviews with Koeman my understanding is that AM are standing in the way of making Tobys loan perm not Toby.

But of course no one knows ( but those in the club ) what is written on the contract or if Toby has pre agreed a deal. If Toby has not pre agreed terms with us then the dead line has no real meaning and should not have been written into his loan agreement to start with, as no transfer can happen with out the player first agreeing to join permanently ( signing a pre contract )

If Toby has pre agreed a contract with us and as the paper's says has been for a medical and discussed a contract with Spurs, maybe the FA are blocking his transfer till the details of the contract between AM and us are known, this could take around a week or so, if it turns out he is a Saints player then AM will be in trouble and Spurs might be too. might be why some people seem to think we are going to take the matter to the FA and FIFA.

I just had to go back to Saintsweb for one more look :playful:

market averages, he's a mercenary, why was he on loan to us..... he proved he was good. He knew he was good, and we were the shop window for his abilities. Just enjoy we had a year of his service.

Although i would like us to sign him.... We were just a shop window, and bouy did we get interest from the bottom feeders...

Too many people hear Champions League and miss what Les, Ronald and Ralph say over and over and over again. We can't and won't be competing with the bigger clubs on fees and wages.

The Champions League thing is just a little dream that if we all pull together we might just do it, like we kind of nearly did in the season just gone.

Playing them next season is going to be very interesting to say the least! Haha. When's the first game? Is it at ours or theirs?

I like this one from Saints Web...

Pretty gutting to be honest. Don't really understand how this has all unravelled but it seems pretty bonkers that we had first option, a permanent transfer clause that was never deactivated, and seemingly, the will of the player, but we have lost out. Not to mention the fact that we were (eventually) prepared to gazump Spurs' offer. Wonder why Atletico seemed so unprepared to deal with us? Lets hope our lawyers do the business and Atletico and Spurs get hit by hefty transfer bans/fines.

This is probably why we have not seen any photos of Alderweireld arriving for his medical as he was tied up with a bag over his head as Levy brought him in kicking and screaming because apparently the will of the player was to sign for Southamption.

"As for Toby... watching him play makes me feel like he is the best CB in the league... his presence, control of the box, leadership of the team etc etc... the guy is a class act completley. He is the best player in our team; better than morgan in CDM and the best CB... No slight on anyone else, but he is simply that good for me. Stands out a mile when he is playing. Haven't seen a player of his standard defensively for saints... ever.... Would love it if we could sign him, but as stated, we are more than fine with Fonte, yoshi, bertrand and Clyne, and they have had morgan and/or vic missing in front of the a lot recently!"
