Archway Press Compulsory Purchase Order
Responsible department: Department for Communities and Local Government



I am petitioning for the regeneration of the area surrounding the Tottenham Hotspur White Hart Lane stadium. One landowner is appealing the rightful Compulsory Purchase Order issued by the Secretary of State (itself taking far too long) and this is delaying the regeneration of the entire area. Such regeneration would create many jobs basically bringing a derelict area into the 21st century and vastly increase local revenue. This ridiculous appeal by a greedy landowner needs throwing out as soon as possible allowing this much needed work to begin. The football club should be applauded for investing so heavily in the area.

Yes, I am also interested to know how long a decision might take after the hearing? Are we talking months? Also, does anyone know on what grounds the appeal has been lodged. Are Archway claiming that the correct process was not followed?

If their appeal is turned down, do Archway have any further options for appeal open to them?

Last CPO appeal I can find that went to the High Court was dismissed after a two day hearing. Landowners then went Court of Appeal which delayed things another 6 months. Theoretically I think this could ultimately be taken to the European Courts but guess we all have to hope Archway would have lost the appetite for the fight by then.

That's depressing! I expect Archway to take things as far as they possibly can for as long as they can, unfortunately.

I wouldn't be surprised if we're here again in January, having just heard about the case being thrown out of the High Court, asking around to see if anyone knows their deadline for an appeal, and then after that their deadline for the European Court...

Archway must be being funded somehow, their legal fees must be through the roof.

I was in 6th form with the son of the man who runs the business about 6 years ago. They're filthy rich. I don't know quite how rich but they're not exactly poor let's put it that way.

Still think the poker game is being played. Getting to the interesting part now, bluff and counter bluff. I wonder if it has truly been spelt out to Archway what they're in for if they lose? I think they'll fold in early January before the day in court* and take the additional money that I think might have been offered to them (nothing for me to go on here).

If I were Daniel I would have offered a sliding scale of additional funds to get this sorted which diminishes as weeks go by :)

*Can I rate my own post as optimistic?

The Article gives the following timetable for the DReamland appeal :

•The council received approval from the Secretary of State (for Communities and Local Government) for the CPO in August 2012.
•The landowners launched a legal appeal challenging the decision by the Secretary of State. A two day hearing took place at the High Court in London on Wednesday 20 and Thursday 21 March 2013.
•This challenge was dismissed by the High Court in ruling given on Thursday 2 May 2013.
•The landowners appealed the High Court decision - late May 2013.
•Cabinet agree to authorise a General Vesting Declaration - 1 August 2013
•The Dreamland site transferred to Thanet District Council - 3 September 2013
•Court of Appeal hearing - 25 September 2013
•Court of Appeal ruling which dismisses the appeal - 8 October 2013

So on that basis, for a High Court Hearing in January 2015, its likely to be 2 months or so to get the result - so March 2015 onwards.

If we lose and Spurs go to a Court of appeal, its a further 6 months.

No but I can....

I doubt they've gone into this blindly. They probably know how far they can take this and for how long, with an idea of how much it will cost them. They are just being stubborn, greedy wankers with the sole intention to delay the project and cost THFC.

My sister is undergoing a CPO now from local council, have been told no avenue at European Court of justice., and must be settled by UK court of appeals.

I agree. The GVD allowed them to take ownership (which might save some time and prevented the landowner from selling the site on) , but I guess that had Thanet lost the case they would have had to hand the land back to the original landowners (or negotiate a price to buy the land - which might be ar a big premium to the CPO 'market value + 10%' rule)

Therre is a difference with the Archway situation though - Archway is an operating business whereas in Thanet I understand that 'Dreamland' was a redevelopment of an old amusement site (ie no operating business at the time of the CPO). We might like to get a GVD to save time on the legal process of transfer of ownership, but we probably couldn't do much with the property until after the Appeal (but I might be wrong on that)

edmonton on rumour from tfc that we will be playing at upton park for 1-2 years: Milton Keynes is current favourite according to my sources. We will defintely be playing somewhere else if the new stadium happens, the opening half finished plan has now been abandoned.

ed re archway: I don't think a settlement will now happen from what I have been told. If anything it is becoming less likely for various reasons on their side.
