I said a while back that even if we got the CPO that for PR reasons we may go back to Archway with one final, generous (considering the CPO/legal rulings) offer. If they don't take it then at least the club has been seen to do everything it can to be reasonable and negotiate with them.
That's a decent shout.

so assuming that no appeal is made today and this was the final deadline, can someone explain what the process now is in terms of knocking down AS and getting on with it.
We all take a hammer to the next home game and join in the fun:).
People don't need to worry about any further negotiation, the land will come under the ownership of the Council who may demolish it themselves or pass it onto us and we'll demolish it eitherway it will be demolished and a stadium will be built on it, whether any negotiations are ongoing, they won't change any of that.
I suspect the only possible negotiations will be Archway still trying to wring the last few pennies out of what they get as market value and stuff.
It's over.

One way or another though am I right in thinking this is the first time that we can be 100% confident that the land will be ours? Presumably the wheels can now be set in motion for all the tendering process, finances etc. It's a hugely significant moment on our journey to the new stadium.

presumably they could build the north end of the new stadium during next season - then maybe we ground share with someone during the 2016/7/8 seasons (or something) while the old stadium is demolished and the new stadium is completed.

I am looking forward to the new design and hopefully increased capacity to 61k. We should also start getting news pretty fast now hopefully confirming naming rights too

Naming rights will probably be announced on 31st August to try and paper over our shit transfer window :)

Unfortunately in the wider context of the scene in Star Wars Episode III: Revenge of the Sith, this gif is inaccurate, due to the fact that Mace Windu, before being on the recieving end of Palpatine's frustration, says 'You have lost', whereas Archway Steel know that they have actually lost.

Still funny though nonetheless.

(Sorry, just wanted to sound like a really geeky know-it-all Star Wars fan, which I'm not :( )

I'm still not entirely convinced it's over. Josif Josif Josif Josif will probably claim squatters rights now.

They could not accept any compensation from the Club and wait for an independent valuation- that would delay it more.

Whatever happens, it will still be quicker than if they had applied to appeal again (and if they were given permission to appeal, we really would have been in a horrific situation).

I'm confident we will see the new stadium before the end of the decade. I still think it will eventually not be completed until 2019. I can't remember if that's what I've predicted before but currently that's my opinion.

I thought in law if a party has turned down "reasonable " offers in the past a lower settlement can be imposed?

Or more correctly they could but from a distance and it wouldn't delay it.

The tendering process was in motion some time ago. There's already a £49m contract underway to construct the foundations and the main superstructure. That contracty had a break clause, in case the appeal succeeded. Now that the appeal has failed, the break clause will not be implemented and the contract can continue works on site, which have been underway for some weeks now.

Excellent news

Harringey can now proceed with a 'vesting order' to legally transfer the propert to them -and in turn that will then be sold to Spurs- think this is a process which will take 3 months.

I'm sure that Archway will ask for more time to move - and I suspect its better to give them an ex tra month or two as it will not affect the build plan (remember Archway will end up being around the centree circle so we will be building around them), but all the financing and planning work can be completed now that the land is asured.

Archway's compenatiion can now be settlede by negotiation at 'market value' - now that they cannot go down the CPO route it comes down to what is the actual value of the premises, and Spurs and Archway will be much closer in their valuations than before the court cases when Archway werte understood to be asking for £20m for prioperty probably worth closer to £1m.But the important point is that the agreement on a valuation has no effect on timing - if it takes 5 years its Josif's problem not Spurs, and its probably in their interests to agree a reasonable sum as earliy as possible

If they're going to build the stadium in phases, then we wouldn't ground-share at all. Phasing it is bloody expensive, bnecause you have to do works out of sequence and multiple times.

If we move out, then the whole reason for doing that it to build the stadium building itself in one 'hit'.

A number of people have translated this already in bits, but here's my version.

The Club has received confirmation that Archway Steel will not be applying to the Court of Appeal for permission to appeal the High Court's decision last month to refuse their legal challenge of the Compulsory Purchase Order.

They gave up. We won.

The next step will be to vest the land in Haringey Council's ownership and to agree the compensation amount payable to Archway.

Ownership of the land gets transferred to Haringey Council and then a market value is set, which ASM will probably challenge - but I think the system is set up so the land gets transferred to a timetable, irrespective of how long it takes to settle on the value. Otherwise, anyone opposing a CPO could lose and then continue to delay matters for years.

We shall also continue to seek to reach an agreement with Archway by private treaty.

A land sale by 'private treaty' just means a direct negotiation between one seller and one buyer, as opposed to a formal tender, an informal tender, an auction or a compulsory purchase. All this means is that THFC will make an offer to ASM, in the hope that they will just take the money and go, thus saving delay and further dispute.

That offer is likely to be more than THFC think the CPO valuation will be, or there is no incentive for ASM to accept it, but it's not going to be a lot more than that, because losing the appeal has removed ASM's leverage. It may even be less than the offer that THFC supposedly made ages ago, I don't know. It depends on how vindictive and aggrieved THFC are feeling and how embittered and angry ASM are.

So, cutting to the chase, who sets the land "value"-a local estate agent as in "Homes under the Hammer?" Are Spurs likely to pay less or more than the CPO premium on the "value?"
