Tottenham likely to get screwed out of sell-on clause

As many of you know, I'm part of FMF State of Mind, a Mexican football blog. I figured I'd pass along a story from that site (andVillarrealUSA) that's relevant toTottenham Hotspur, regardingGiovani dos Santos. Unsurprisingly, he has a sell-on clause, which is howMallorcawere able to get him so cheap. While Gio had a very good season in La Liga last year, Mallorca got relegated and are looking to sell him. Yay, payday! Right? Wrong.
See, Villarreal are trying to sign two Mallorca players, much like Monaco signed two players from FC Porto. To avoid paying a lot of money to Sporting Lisbon, who stood to make a lot of money on a sell-on clause that they had for Joao Moutinho, Porto sold Moutinho to Monaco for far below market value and James Rodriguez for far above market value. This allowed them to pull in the same total fee, but while having to pay less to Sporting.
Mallorca is trying to do the same thing with Gio and Tomas Pina. Take it away, Villarreal USA.
Reports suggest that Pina's transfer could be for up to €5 million, but everything depends on the Giovani dos Santos situation. If Mallorca wants to stiff Tottenham, then both players need to go to the same club. Pina's arrival should give us a leg up, but the islanders are pesky negotiators.
And here's what I said about that over at FMF State of Mind.
Gio has a sell-on clause, meaning Tottenham Hotspur will get a portion of any potential sale. If Villarreal can get a deal done with Gio, they'll likely pay a large fee for Pina and a small fee for Gio. How that works, I have no idea. One would think that, since Pina has already signed, his fee is set. I'm not sure how "signing Giovani dos Santos" can be written into a contract as an incentive/fee escalator, but I'm sure they figured out a legal way to pull this off.

This is shady and it sucks, but there's nothing to stop them from doing it. It's almost certainly legal. Them's the breaks. Fair enough I reckon, they're hardly the only ones playing the system. We got involved in similar shenanigans to sign Fryers.

Spot on. It's the only sensible position to take after all.

Anyways, not seeing why this is so bad. Doesn't even seem that shady to me. Just a workaround and our bad luck that although he was reasonably impressive last season, he wasn't so impressive as to invite more suitors.

Just glad he's gone tbh Cut our losses.

Yeah but that £2mil is basically 5 months worth of £100k p/w wages, or a full season of £50k p/w wages. No matter how small it seems, it could make quite a difference to what could be added to the wage of a real quality player.

Pretty sure that once it became apparent that Gio wasn't settling well, Levy restricted Gio's game time to prevent a clause in his contract being activated. We definitely took steps to avoid paying Barca extra cash.

Surely this stuff happens all the time. Either way the sell on fee on what Gio will go for isn't going to be a lot, so it's not going to hit us. I very much doubt it's money Levy will have been banking on.

Meh. Don't really care, risk you take with sell on clauses they don't always come to fruition and the amount you expect isn't the amount you get.

Win some (sneaky deal for Fryers), might lose some (Gio). Shit happens.

The sell on clause is for the amount he is sold for to the new club, not what we sold him for.

E.g we sold him to Mallorca for £2m, the following season Mallorca sell him for £10m if we had a 25% sell on clause we would get 2.5m

Fryers deal isn't comparable, have no problem with that one.
Had much more of a sour taste in my mouth about how we did as Mallorca intend, against Brighton
when we gave Zamora away as part exchange for Defoe - value was set at £500k which was the highest fee that wouldn't trigger a sell on clause.

I actually feel that United have bigger reason to be embarrased of their actions in the Fryers case than we do.

Amazing! Levy gets out-Levy'ed. You would think from now on there will be some sort of new clause in these sell on fee deals to avoid this in the future, such as us being entitled to some percentage of the total fee, should it be a multi-player deal.

To be honest, I might confuse it with the Etherington/Kanoute deal.
Point even stronger though, we've similiar shady dealings in the past - screwing over lesser clubs in dire need of money.

At the time of Gio's sale I recall it being reported that the sell on clause was 50%. The idea was that in return we let Mallorca have him at a particularly generous price. So considering that the sums being bandied around in the press for Gio this summer have been around the £8m mark we could well be looking at missing out on a fair wedge here. We're not talking an insignificant amount as suggested by some above.

Late to this thread, obviously, but am i the only one who started reading the opening article, sees the words bolded/italic and wonder if that's some kind of template where you just fill in details from a drop down list for various fan groups?

Odd formatting indeed... or is that my eyes doing that?
