Not sure of the details, but I've always understood they aren't legally binding here like they are in Iberia.

You can have a buyout clause in this country and they are legal. In Iberia as you say....it is a law that they have to be inserted into every contract. It's why Messi has a buyout of something ridiculous, well into the 100s of millions. Nobody is going to meet it, but they have to be there for law.

Isn't there a rule about players over 28 being being able to buy out their contracts? It it tied in with how long the contract still has to run. Benni is 28 in a couple of months!! I think he can buy out his contract in the summer. Providing the signing-on fee pays off the cost of buying out the remaining 3 years of his contract; it could be a lucrative move on his part. Would be Levy's fault for not paying him his worth.

Glad to see we haven't curried the goat yet!

I don't think Benny would go to Arsenal but if he does have a buy out clause in his contract I can't blame him for using this alleged bid to get a bigger contract. If what the goat has been fed is true then we should just give him a pay rise and jobs done - simples

I don't think Daniel Levy would be stupid enough to put a buy out clause in any contract, and if you take that out of the equation I don't think Arsenal could afford one.

Could be some truth about the over 28s rule, Although I thought Ekotto had signed a new deal not too long ago. Again Levy is smarter than all of us I am sure the club will have planned so no player is eligible for the over 28 thing

See the Webster ruling:

Article 17 of FIFA's Regulations for the Status and Transfer of Players is entitled "Consequences of Terminating a Contract Without Just Cause", and is the fifth article of Chapter IV, "Maintenance of Contractual Stability between Professionals and Clubs". It outlines the provisions which apply if a contract is terminated without just cause, and the requirement for the party in breach to pay compensation.[9] Specifically, it states that any player who signed a contract before the age of 28 can buy himself out of the contract three years after the deal was signed. If he is 28 or older the time limit is shortened to two years.[10][11] Article 17 was introduced in December 2004, with effect from 1 July 2005.

In the summer Benny can buy out his contract for the cost of 2 years wages (say £4m). Signs for Arsenal for £8m taking a £4m profit and doubling his wages. Over to you Daniel.

I thought there was a gentleman's agreement between clubs that they would not use this rule, as basically it will mean the end of transfer fees.

There was amongst some of the top clubs but I am sure that the agreement has been breached since.

If (and it's a bloody big 'if') this has legs, which I sincerely doubt, then I have faith that the club will sort it out quick smart. There is no way we're going to let one of the best defenders in the league go down the road to that bunch of ****s (again).

Still worries me a little though - JJetset, please comment that this is all bollocks.

Surely this wouldn't get anywhere through court what with Benny having no reason to break the contract? If Arsenal pull this off I'd think Spurs have the grounds (and Levy's sneaky bugger lawyers) to at least get full compensation.

Which is irrelevant really because we'll probably offer an improved contract.
